Commission Rules and T.O.S.

Updated: 3/22/2026Upon purchase of a commission from x-Exspiravit-x you acknowledge to having read and agree to abide by the following terms of service:

You are NOT permitted to do any of the following to/with my artwork for any reason:- Copying, altering, tracing, recoloring, stealing or otherwise claiming my work as yours
- Making a base from and/or using my work as a base
- Using my artwork for commercial purposes (Selling my artwork on T-shirts, mugs, etc.)
- Removing, obstructing or altering my watermark—WatermarksSome images may include my personal, nonintrusive watermark which may not be not be cropped, edited, altered, erased or otherwise intentionally obstructed or removed. I'm inconsistent about watermarking my designs. You will not be given an unwatermarked file if one is not already provided.—RepostingI. Credit me any and every time my artwork is reuploaded / reposted to any site (DeviantArt, Instagram, Twitter, etc.)
II. I ask that you not crop, edit, alter, or otherwise intentionally obstruct or remove my watermark (when applicable).
III. Please credit me for the artwork any and every time you are to repost it!↓Tag me for credit on any of the following websites:

II. I will require your PayPal email address in order to file an invoice.
III. Payment plans and extensions are not available for commissions.—RefundsOnce I complete the sketch of your commission I will send it to you. If you are satisfied with the sketch I will then ask for payment. Once payment is received the exchange is non-refundable, no exceptions.

Commission Information

Once I finish my sketch I will send it to you through DMs (via Dropbox link) and ask if you wish for any alterations to be made. This is in case I missed any details and/or need to make any adjustments.If you are satisfied with the sketch I will then ask that payment be sent. Once payment is received I will begin working on finishing your commission.If payment is not received, I will not finish your commission. Any redistribution or use of the unpaid for sketch will be faced with DMCA reports filed against you.I will NEVER take more than a week to complete a commission!
(Unless something severe happens in my personal life, expect the commission within a few days! If I am unable to accept or complete your commission you will be informed about it!)—I will draw:- Any gender, race, body type, physical disability, etc.
- Original characters & fan characters
- Blood and gore
- Suggestive or NSFW content (of characters that are 18+)I will NOT draw:- Fetishes
- Zoophilia/Bestiality, pedophilia, etc. (You will be blacklisted.)
- Propaganda, hate/kill art, etc. (You will be blacklisted.)
- Overly Complicated Designs—Please always include the following information when purchasing a commission:- COMMISSIONED BY: (Your Username)- Character(s) Featured: (Character's name(s))- Character(s): (Clear reference sheet(s) or image(s) of your character(s))- Commission Type: (Style genre & length)- Description: (A short description of your character's personality and traits as well as what you'd like included in the commission (pose, expression, objects, etc). You're also more than welcome to give me artistic freedom if you have no clear ideas.)- T.O.S. Watermarks
Some images may include my personal, nonintrusive watermark which may not be not be cropped, edited, altered, erased or otherwise intentionally obstructed or removed. I'm inconsistent about watermarking my designs. You will not be given an unwatermarked file if one is not already provided.──────────────────────────────────
Design AlterationsYou are allowed to make the following changes to my designs:
- Change Species
- Change Gender, Sexual Orientation, etc.
- Change Genres (ferals into anthros and vice-versa, etc.)
- Alter/Add/Remove clothing and other accessories
- Alter/Add/Remove small details such as tattoos, piercings, etc.I. Please do not change over 30% of the original design. (In other words: Don't make it entirely unrecognizable from the original.)II. Please do not alter / edit the original artwork of the design by tracing, recoloring, frankendolling, etc.III. Please keep the original design saved somewhere! Do not separate the redesign from the original to resell individually.IV. If you are unsure if your changes are too derivative don't be afraid to ask!──────────────────────────────────
Reselling, Co-Ownership, Gifting & TradingI. You are allowed to resell, give my designs as gifts and/or trade my designs. (My designs may NOT be gifted, sold to or otherwise traded to any individuals on my blacklist or any otherwise problematic users.)II. I do not allow co-ownership of my designs as I will not be held responsible for mediating arguments about which party owns the design.III. You may NOT resell / trade my designs within 1 month of purchase. Reselling / trading my designs within this timeframe will result in you being greylisted. (I'm tired of seeing my designs being resold / traded DAYS after they were adopted. Don't bother adopting them at all unless you actually intend to use them.)IV. If you intend to resell a design it may not be sold for more than they were purchased for UNLESS additional artwork is created or commissioned (This includes artwork you have drawn yourself, however, please keep the additional value reasonable and do not scribble a bunch of doodles just to re-sell the design for a higher price.)──────────────────────────────────
Refunds & ReturnsI. All purchases are non-refundable, no exceptions.
II. You may return an adopt / design at any time if you no longer wish to have ownership (If you no longer feel connected to them, haven't used them, etc.) however you will not be given refund for them.
III. You may offer to sell the character back to me but I am not required to accept it
IV. If the character has been returned to me it will then be resold or kept by me.──────────────────────────────────
Payment
I accept PayPal and other forms of art / design trade, however some adoptables may be listed with a set price that cannot be negotiatedPayments via PayPal will be made via invoice. Your PayPal email address will be required.—
Payment Plans & ExtensionsI allow holds on characters up to 24 hours by default.
Payment plans can be negotiated. If you need to make a plan let me know and we can try to work something out.I will not do holds for longer than a month, so payment plans are limited to that time frame.If you have offered artwork or custom design in exchange for a design:
I. You will have three weeks to complete your offers. In that time the design you offered for will be placed on HOLD.
II. If trades are not completed by the specified time frame, the character you offered for will be reopened for others to offer on. I will give you a reminder when the three weeks' deadline is approaching.(Please do not offer art trades if you are unable/unwilling to finish your trades by the time given. I will no longer be providing further deadline extensions.)──────────────────────────────────
Character & Design Terms Of ServiceI. Some designs may have an Access Key named "Designer Key".
You may NOT delete this key - It is there to ensure I can keep track of the design.II. You may NOT delete my designs from Toyhou.se!You are purchasing:
The ownership and rights to the character / design abiding by the specified guidelines of use; You are not given credit for the creation of the character / design.Upon purchasing:
- You will be the sole owner of the character / design. I do not allow co-ownerships.
- You may use the design in artwork, roleplay, ships, literature, etc.
- The design is for personal use ONLY. You may NOT use the design for commercial purposes (selling shirts, prints, physical goods, etc.)You may commission / create NSFW artwork of the design abiding by the following restrictions:I. Any character / design purposely listed as a minor, feral, or otherwise unconsenting party may NOT be used for NSFW purposes.
If I find you doing so revocation of the design will occur immediately and you will be permanently backlisted.II. I ask that my designs not be used for niche fetish purposes (IE. Diaper, foot, inflation, urination/defecation, etc.) I don't want to see my work used in such a way. I don't mind kink but the aforementioned 'fetishes' are where I draw the line.I retain the original copyright of the character / design, artwork and the credit for the creation.Upon severe violation of my terms of service the offender's character / design ownership can be revoked.I have every right to revoke ownership of the design at my volition. This is only in the case of severe violations such as drawing underage designs in NSFW contexts or purposefully giving my designs to blacklisted individuals.

Implied Contract & AgreementUpon purchase, trade or acquiring of a design from x-Exspiravit-x you acknowledge and are agreeing to the following:You will be held liable for any misuse of the character / design and any violation of specified terms of service. If you violate T.O.S., rules or other policies it may result in the revoking of the design and rights to use without a refund, you being blacklisted and / or my filing a DMCA claim against you for the removal of content if you refuse to cooperate.The following agreement is binding upon the acquiring of any designs created by x-Exspiravit-x:"I, [Your Username], agree to abide by the specified terms and conditions associated with this design. I acknowledge that I am abiding by these conditions upon purchase and I am aware of the consequences should I violate the listed terms of service.
